Question by Bruce & Kelly: Should I get a spy camera? If so, whats the best image specs so that it can be used as evidence?
Here’s the thing….My friend (“j”) is split-up from his wife (“s”) at current moment because, of issues. She “s” submitted a pfa on him a couple of weeks ago for abuse on HER son (17) years old. “j” asked the child to do a chore and the child responded by threatening to bash “j” head in with a crowbar, “j” then reacted and told the child that he does not talk like that and that he was going to ground him if he did not watch his tone, and attitude. Child continued to go off then ran to his mother “s”, stating lies. “s” approached “j” and threatened him as well. Then filed a pfa on “j” next day. They went to court a week later, and “s” wanted to cooperate and drop charges. This was done, and visitation with “s” & “j”s children was sat for “j”. HOWEVER, “j” forgot to mention that HE DID NOT want “s”s child to be around their children alone because, of his attitude and the way he treats “s” & “j”s children. Lawyer told “j” that in order to do anything he needs to file a pfa on “s”s child, against the boys, and that he will need evidence. This said child is VERY abusive to Justin and “s” & “j”s 2 boys. “s”s child has punched “j” before and gave him a black eye, he has also been caught hitting and screaming at the two little boys ages (8, & 6). Anyhow, “j” needs evidence, and we are trying to figure out a way of evidence. In the state of Kansas it is a “one party acknowledgement state” therefore as long as one person knows about a video recording or voice recording it is allowed in court. So, we were thinking of something like a “pen spy camera” or “teddy bear” etc. For the boys to have that may possibly catch some abuse, so that “j” can have evidence in order to file a pfa. Is this a good option for evidence? If so what are the best specs for a spy camera for the best possible image? ALSO, since this would be given to a child again ages (8&6) we were looking for good options of the type of spy camera…ie…watch, pen, bear etc. AND since it is a one party acknowledgement law, does that mean the CHILD has to acknowledge this, or the parent of which is doing it? We do not want the children to know, I mean yes we hear what they say but, lawyer has said that it would be considered hear say in court as the children are not old enough to be held as witnesses, and the fact that “s” would manipulate them before court anyhow….Any ideas?? Please help…AND remember this is for the sake of the children, their situation is sad having parents split up, but, the abuse must end both verbally and physically. No CHILD should have to go through this!!!
